Unsuccessful Democratic candidate for state senate sued Republican organizations that had a hand in creating and distributing this ad. There were, the First Circuit Court of Appeals allowed, some errors in the ad. For example, Schatz had actually not voted against funding for the Fourth of July celebration. But the plaintiff was unable to demonstrate that defendants knew of the ad's falsity. See Schatz v. Republican State Leadership Committee, 669 F. 3d 50 (1st Cir. 2012).
